Actually it is no different to deciding if you want to have an arbitrator rather than a full court hearing. An arbitration decision can be legally binding as well, but only if it fall within the legal outlines set by the UK courts. I believe USA has a similar system with a go between rather than filling up the courts with civil disputes.
I must admit when I first heard about it I was pissed off. But upon actual research into the subject both sides would have to agree to abide by the decision of the arbitrator, and any decision take by an arbitrator can go to a normal court of law for appeal, but like I said both parties have to agree to arbitration first.
